Privacy Policy for the Magic IT-Ball App

1) Scope

This privacy policy applies to the Android app “Magic IT-Ball”. The app is free and is offered through Google Play.

For visits to our website, the website privacy policy applies.

2) Controller

The provider of the app and the controller within the meaning of the General Data Protection Regulation (GDPR) is Smitey Inh. Thorsten Nierfeld. You can find the postal address and further contact details in the legal notice.

3) The app collects no personal data

The app does not collect, store or send any personal data. It has no permission to access the internet. It contains no analytics, advertising or tracking services. There is no user account.

The voice clips, card texts and images are part of the app. The app does not download anything.

4) Permissions and motion sensor

The app requests only one permission: vibration. It lets the device vibrate briefly. You can turn vibration off in the app settings.

To detect shaking, the app reads the device’s motion sensor. The values are only evaluated on the device. They are neither stored nor sent.

5) Settings

The app stores your settings for sound, vibration and snow amount only on your device. We do not receive these settings.

The settings are deleted when you uninstall the app or clear its data in the Android settings.

6) Links and QR code

The app settings contain links to smitey.eu and to this privacy policy. The cards show a QR code that leads to smitey.eu.

When you open a link or scan the QR code, your browser opens. This happens outside the app. For visits to the website, the website privacy policy applies.

7) Google Play

Downloads, installation and updates of the app are handled by Google Play. Google processes data under its own privacy policy.

As the provider of the app, we receive aggregated, anonymous statistics from Google Play. These include, for example, the number of installs and crash statistics. We cannot identify individual persons from them.

8) Your rights

The applicable data protection law grants you the following rights vis-à-vis the controller:

• Right of access pursuant to Art. 15 GDPR;
• Right to rectification pursuant to Art. 16 GDPR;
• Right to erasure pursuant to Art. 17 GDPR;
• Right to restriction of processing pursuant to Art. 18 GDPR;
• Right to data portability pursuant to Art. 20 GDPR;
• Right to object pursuant to Art. 21 GDPR;
• Right to lodge a complaint pursuant to Art. 77 GDPR.

Because the app collects no personal data, we hold no data about you from the app. You can still contact us with questions at any time at privacy-protection@smitey.eu.
